1. acceptance of terms

By downloading, installing, or using seek-nothing (“the App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.

2. description of service

seek-nothing is a meditation application built on the Solana blockchain. Users stake SOL tokens before beginning a meditation session. If the user remains still for the duration of the session, they receive their stake back. If movement is detected, the staked SOL is forfeited to the program.

3. eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

4. wallet and blockchain interactions

  • You are solely responsible for maintaining the security of your Solana wallet and private keys.
  • All transactions on the Solana blockchain are irreversible. We cannot reverse, cancel, or refund any transaction once it has been confirmed on-chain.
  • You are responsible for ensuring you have sufficient SOL in your wallet for transactions and associated network fees.

5. staking and forfeiture

  • By initiating a meditation session, you voluntarily stake SOL tokens to the on-chain program.
  • Movement detection is performed locally on your device using sensor data. The App's determination of movement is final.
  • If movement is detected during a session, the staked SOL is forfeited. You acknowledge and accept this risk before starting each session.
  • We are not liable for any SOL lost due to device sensor inaccuracies, network issues, or any other technical factors.

6. risks

You acknowledge and accept the following risks:

  • The value of SOL tokens is volatile and may fluctuate significantly.
  • Blockchain networks may experience congestion, outages, or other disruptions.
  • Smart contracts and on-chain programs may contain bugs or vulnerabilities despite best efforts in development and testing.
  • Regulatory changes may affect the availability or legality of blockchain-based applications in your jurisdiction.

7. prohibited uses

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law.
  • Attempt to exploit, hack, or reverse-engineer the App or its on-chain program.
  • Use the App if you are located in a jurisdiction where the use of blockchain applications or digital assets is prohibited.
  • Interfere with or disrupt the operation of the App or the Solana network.

8. intellectual property

All content, design, and code of the App are the property of seek-nothing or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. disclaimer of warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOU USE THE APP AT YOUR OWN RISK.

10. limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR DIGITAL ASSETS, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

11. indemnification

You agree to indemnify and hold harmless seek-nothing and its developers from any claims, damages, losses, or expenses arising out of your use of the App, violation of these Terms, or violation of any applicable law.

12. modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the App after changes constitutes acceptance of the updated Terms.

13. termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason. Upon termination, all licenses granted to you under these Terms will immediately cease.

14. governing law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
